01Who we are and what this covers

This policy describes how Project 38 LLC, a California limited liability company at 500 S. Victory Blvd, Burbank, CA 91502, handles personal information collected through project38.live, our payment pages and links, and our work with clients. Reach us at team@project38x.com or (805) 328-8889.

Our website is a marketing site. It has no accounts and no sign-in. Most of the information we hold comes from you contacting us, hiring us or paying an invoice.

02Information we collect

When you contact us: your name, email address, phone number and whatever you include in your message.

When you hire us: the information needed to quote, contract, schedule and deliver the work, such as your company, role, venue and production details, and the contents of agreements you sign with us, including any documents signed electronically through our e-signature provider.

When you pay through our payment pages: your name, email address and billing address, and the invoice or agreement the payment relates to. Card details are collected and stored by our payment processor, Stripe. We never see or store your full card number. Where a rental agreement places a card on file, Stripe holds the saved card against your customer record with us.

When you visit the website: our hosting provider records standard server logs, such as IP address, browser type, pages requested and timestamps, used for security and to keep the site running. We do not run advertising or analytics trackers on this site.

03How we use it

To respond to you, quote and deliver production services and equipment rentals, schedule crew and gear, send receipts, statements and invoices, process payments and refunds, keep the records the law requires, resolve disputes, and protect the site and our business.

We do not use your information for advertising and we do not sell it.

04Who we share it with

Service providers that help us operate, each bound to use the information only for the service they provide us: Stripe (payment processing, receipts and invoices), our e-signature provider (agreements), our email and calendar providers, and Vercel (website hosting).

Crew and affiliated companies working on your production, to the extent needed to deliver it. Project 38 works from a facility operated by an affiliated company, Nucci Holding Co LLC, which may also process payments for us where a payment page says so.

Professional advisers such as our accountant and lawyers, and authorities where the law requires it or to enforce an agreement.

05How long we keep it

Billing, payment and agreement records are kept as required for tax, accounting and legal purposes, typically at least seven years. Correspondence and production records are kept for as long as they are useful to our work with you. When information is no longer needed, we delete or de-identify it.

06Security

The site and our payment pages are served over encrypted connections. Card and bank details are handled by Stripe, a PCI-DSS compliant processor, so they never touch our systems. No system is perfectly secure; if a breach affecting your personal information occurs, we will notify you as California law requires.

07Cookies and Do Not Track

project38.live sets no cookies of its own. Stripe's payment pages use cookies necessary for checkout security and fraud prevention, governed by Stripe's privacy policy. We do not respond to Do Not Track signals because no common standard has been adopted, and we do not track visitors across other websites.

08Your choices and rights

You may ask us to access, correct or delete the personal information we hold about you, or to remove a card on file once your agreement is fully settled. Email team@project38x.com. We may verify your identity first, and we may keep records the law requires us to keep, such as billing and tax records. We will not treat you differently for exercising these rights.

For rights over payment details held by Stripe, see Stripe's privacy policy; we will assist with requests relating to our records.

09California privacy rights

California residents may have rights under the California Consumer Privacy Act, including the rights to know, delete, correct and opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined in that law. Whether or not the law applies to us, we honor the access, correction and deletion requests described above for everyone.

10Children

Our services are for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe we have, contact us and we will delete it.

11Changes to this policy

We may update this policy from time to time. The current version and its effective date are always at project38.live/privacy. Material changes will be noted on this page.
